Corporate Retainer Program
For a nominal monthly fee, associations can enroll in our unique program that has provided extended legal services and significant savings to condominium, townhome and homeowner association groups for over 15 years.
The corporate retainer program includes:
- preparation and revision of contracts and other legal documents, including construction and bank loans
- drafting and enforcement of association by-laws and covenants
- analysis of association governing documents and preparation of legal opinions
- preparation of amendments to the association's declaration and by-laws
- drafts and revisions of rules and regulations
- serving as the association's registered agent and preparing the corporate annual report
- reduction of common area and association-owned property tax bills
- preparation of correspondence to third parties in dispute with the association, including residents, neighbors, insurance companies, developers and municipalities
- telephone calls concerning any of the above matters
Excluded items are out-of-pocket costs, attendance at meetings and proceedings pertaining to collection of delinquent assessments and other litigation, administrative actions and alternative dispute resolution.

For a nominal monthly fee, selected association board members and the property manager have unlimited telephone and e-mail access to Kovitz Shifrin Nesbit attorneys who focus on the day-to-day issues that impact association living. Association board members no longer have to judge what constitutes an issue that is "significant enough" for legal attention. In fact, asking those minor questions rather than waiting for the issue to become a major problem can be a healthy dose of preventative medicine.Our communication retainer program entitles a designated board member (usually the president) to contact any attorney in the firm regarding their association. If the association is professionally managed, the communication retainer program also covers all communication with the property manager.
